1. Introduction & Acceptance

Welcome to MORDERN MAGIC. MORDERN MAGIC GROUP LIMITED is a company incorporated in Wyoming, United States, and operates a short-form drama streaming service (the Service) accessible via the TikTok platform as a mini program and any related websites, applications, or services we operate (collectively, the Platform).

These Terms of Service (Terms) govern your access to and use of the Service. By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.

BY CLICKING "I AGREE", REGISTERING AN ACCOUNT, OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND ACCEPT THESE TERMS AND OUR PRIVACY POLICY, AND YOU ENTER INTO A BINDING LEGAL AGREEMENT WITH US.

2. Eligibility

2.1 Minimum Age

• You must be at least 13 years old (or the equivalent minimum age of digital consent in your jurisdiction) to use the Service.
• If you are between 13 and 18 (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
• We do not knowingly collect personal information from or provide the Service to children under 13. If we become aware that we have collected personal information from a child under 13, we will delete it as soon as possible.

2.2 Jurisdictional Restrictions

• The Service is available globally, excluding jurisdictions where short-form drama streaming, virtual currency, or related services are prohibited or restricted by local law.
• You are solely responsible for ensuring that your use of the Service is lawful in your jurisdiction.
• We reserve the right to geo-block or restrict access from any jurisdiction at our sole discretion.

2.3 Account Integrity

• You may be required to register an account through TikTok, email, or a third-party identity provider (Google, Apple, Facebook).
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Service Description

The Service provides access to short-form drama content (typically 1-5 minutes per episode) via streaming. The Service is operated as a TikTok mini program and may also be accessible through our affiliated web properties. Our content library is updated regularly. We do not guarantee the availability of any specific title, episode, or series. We reserve the right to add, modify, or remove content at any time without prior notice. Some content may be region-locked due to licensing, regulatory, or rights-holder restrictions. We strive to maintain continuous availability but do not guarantee uninterrupted, error-free, or secure access. We may suspend, restrict, or terminate the Service (in whole or in part) for maintenance, upgrades, technical issues, or other operational reasons.

4. Account, Subscription & Virtual Currency

4.1 Account Types

• Free Account: Limited access to content with optional ad-supported viewing or pay-per-episode purchases.
• Subscribed Account: Unlimited access to a defined content library for a recurring fee (weekly, monthly, or annual).
• Hybrid Account: Combination of subscription plus optional virtual currency purchases for premium content.

4.2 Subscriptions & Auto-Renewal

• Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
• Subscription fees are billed through TikTok's in-app payment system (TikTok Pay). All payment processing is subject to TikTok's Payment Terms in addition to these Terms.
• We will notify you of any price changes at least 30 days in advance. Continued use after a price change constitutes acceptance of the new price.
• How to cancel: Open TikTok, go to Me, Settings, Balance, Order History. Find the active subscription and tap Cancel Subscription. You may also manage subscriptions through your TikTok account settings.
• Cancellation takes effect at the end of the current billing period. You will retain access to subscribed content until the end of the period for which you have already paid.
• No refunds for partial subscription periods, except where required by law (e.g., EU 14-day cooling-off right).

4.3 Virtual Currency (Drama Coins)

• We may offer a virtual currency (Drama Coins or similar) that you can purchase through TikTok Pay to unlock individual episodes, premium content, or special features.
• Drama Coins have no real-world monetary value and cannot be exchanged for cash, transferred to other users, or refunded, except where required by law.
• Drama Coins may expire after 12 months of inactivity on your account. We will notify you at least 30 days before expiration.
• We reserve the right to modify the pricing, exchange rate, or redemption rules of Drama Coins at any time.

4.4 Pay-Per-Episode

• Individual episodes or series may be purchased for a one-time fee (in-app currency or local equivalent).
• Purchased content is tied to your account and is non-transferable.
• Once an episode is fully watched or unlocked, no refund will be provided, except in cases of demonstrable technical failure on our part.

5. Payment & Refund Policy

5.1 Payment Processing

• All payments are processed by TikTok Pay (or its affiliates). You authorize TikTok to charge your selected payment method for all applicable fees.
• You agree to TikTok's Payment Terms and the payment method provider's terms.
• You represent that you are the authorized user of the payment method used.

5.2 Refund Policy

• General Rule: All purchases are final and non-refundable once content has been streamed, downloaded, or otherwise accessed, except as required by applicable law.
• EU/UK Users: If you are a consumer in the European Union or United Kingdom, you have a 14-day cooling-off right to withdraw from a subscription purchase, provided you have NOT commenced streaming content during that period. By commencing streaming, you expressly waive your right of withdrawal for digital content under Article 16(m) of the EU Consumer Rights Directive 2011/83/EU and the equivalent UK regulations.
• California Users: Refund requests are handled on a case-by-case basis, in accordance with California Civil Code Section 1689 et seq.
• Chargebacks: Initiating a chargeback without first contacting our support team may result in account suspension. We reserve the right to dispute chargebacks we believe are fraudulent or in violation of these Terms.

5.3 Taxes

• Prices displayed are inclusive or exclusive of applicable taxes (such as VAT, GST, or sales tax), depending on your jurisdiction and TikTok Pay's display configuration.
• You are responsible for any taxes applicable to your purchases, except for taxes on our income.

6. User Conduct & Prohibited Activities

You agree NOT to:

1. Account Misuse: Create multiple accounts to abuse free trials, promotional offers, or referral programs.
2. Account Sharing: Share, sell, transfer, or sublicense your account or subscription access to any third party.
3. Content Misuse: Record, screenshot, rebroadcast, redistribute, or commercially exploit any content accessible through the Service.
4. Reverse Engineering: Decompile, disassemble, reverse engineer, or otherwise attempt to derive source code, underlying algorithms, or non-public features of the Service.
5. Automated Access: Use bots, scrapers, crawlers, or other automated tools to access the Service, except for our published APIs.
6. Security Violations: Probe, scan, or test the vulnerability of the Service, or breach any security or authentication measures.
7. Illegal Use: Use the Service for any unlawful purpose, including infringement of intellectual property rights, fraud, money laundering, or financing of terrorism.
8. Harmful Content: Upload, post, or transmit any content that is defamatory, obscene, harassing, hateful, racially or ethnically offensive, or that encourages violence.
9. Circumvention: Circumvent, disable, or otherwise interfere with security-related features, including content protection, geo-blocking, or usage limits.
10. Resale: Resell, redistribute, or commercially exploit access to the Service.

7. Intellectual Property Rights

7.1 Our Content

• All content available through the Service, including short-form dramas, videos, audio, images, text, graphics, logos, and software, is the property of MORDERN MAGIC GROUP LIMITED, our licensors, or our content partners, and is protected by copyright, trademark, and other intellectual property laws.
• We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the content solely for your personal, non-commercial entertainment use within the Service.
• This license does not transfer any ownership rights to you.

7.2 Your Content

• If you submit reviews, comments, feedback, or other user-generated content, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, distribute, and display such content in connection with the Service.
• You represent that you own or have the necessary rights to any content you submit, and that such content does not infringe any third party's rights.

7.3 DMCA Takedown (United States)

• If you believe content on the Service infringes your copyright, you may submit a DMCA notice to our designated agent at dmca@mordernmagic.com containing:

1. Your physical or electronic signature
2. Identification of the copyrighted work claimed to have been infringed
3. Identification of the infringing material and its location on the Service
4. Your contact information
5. A statement of good-faith belief that use is not authorized
6. A statement, under penalty of perjury, that the information is accurate and you are authorized to act for the copyright owner

• We will process valid DMCA notices in accordance with 17 U.S.C. Section 512.

7.4 Trademarks

• MORDERN MAGIC, the MORDERN MAGIC logo, and related marks are trademarks of MORDERN MAGIC GROUP LIMITED. You may not use these marks without our prior written consent.

8. Content Rating & Age Restrictions

• All content on the Service is rated PG-13 / 13+ (suitable for ages 13 and above).
• We do not knowingly make available content that is restricted to adults (18+) in any jurisdiction.
• Age-gating mechanisms (e.g., date of birth verification) may be applied to specific content in specific jurisdictions.
• Parents and guardians are responsible for monitoring minors' access to the Service.

9. Disclaimers & Limitation of Liability

9.1 Service AS IS

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN AS IS AND AS AVAILABLE BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF CONTENT.

9.2 No Guarantee

We do not warrant that:

• Defects will be corrected;
• The Service or the servers that make it available are free of viruses or other harmful components;
• The content is accurate, complete, or current.

9.3 Limitation of Liability

• DAMAGES RESULTING FROM (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT,

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN JURISDICTIONS WHERE LIMITATION OF LIABILITY IS NOT PERMITTED (e.g., certain EU member states), OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND IN ANY EVENT TO THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

• Termination does not entitle you to a refund of fees already paid, except as required by law.
• Upon termination, your right to use the Service ceases immediately.

10.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, with or without notice, for reasons including:

• Violation of these Terms;
• Suspected fraud, abuse, or illegal activity;
• Extended periods of inactivity (typically 12+ months);
• Requirements of law, regulation, or third-party rights holders.

10.3 Effect of Termination

• Upon termination, all licenses granted to you under these Terms will immediately cease.
• Sections of these Terms that by their nature should survive termination (including but not limited to Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution) shall survive.
• We may retain certain data as required by law or for legitimate business purposes, in accordance with our Privacy Policy.

11. Indemnification

You agree to defend, indemnify, and hold harmless MORDERN MAGIC GROUP LIMITED and its officers, directors, employees, agents, suppliers, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys fees) arising from:

12. Dispute Resolution & Governing Law

• Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
• The arbitration shall be conducted by a single arbitrator in the State of Delaware (or, if you prefer, by video conference).
• The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
• You and we agree that any arbitration shall be conducted only in an individual capacity and not as a class action, consolidated action, or representative action.

12.4 Exceptions

• Either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction.
• Either party may bring a qualifying claim in small claims court.
• This arbitration agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies.

12.5 EU/UK Users Right to Forum

• If you are a consumer in the EU or UK, you may also bring proceedings in the courts of your country of residence.

• If you do not agree to the changes, you must stop using the Service and may close your account.

14. Miscellaneous

14.1 Entire Agreement

These Terms (together with the Privacy Policy) constitute the entire agreement between you and us regarding the Service.

14.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms are provided in English. In case of any inconsistency between the English version and any translated version, the English version shall prevail.
